Terms of sale.
These terms govern your use of cyrusdrinks.com and any purchase you make through it. They apply to consumers ordering for personal use. Trade and Horeca accounts operate under a separate written agreement set up via the business portal.
1. Who you're buying from
The seller is CYRUS B.V., a private limited company registered in Amsterdam under Chamber of Commerce (KvK) number 87654321, with a VAT identification of NL862451039B01 and an alcohol licence (ALV-AMS-2024-1187) issued by the municipality of Amsterdam under the Alcoholwet (the Dutch Alcohol Act).
Registered office: Distillerstraat 12, 1033 ZX Amsterdam, the Netherlands. Correspondence: info@cyrusdrinks.com.
2. Who can order
You must be at least eighteen (18) years old at the time of purchase. The site age-gates entry, and the carrier verifies recipient age on delivery. If a recipient cannot produce ID showing they are 18+, the delivery will not be handed over; we will refund the order minus the outbound shipping charge if a redelivery is refused.
The Netherlands prohibits the sale of alcoholic beverages to persons under 18 under Article 20 of the Alcoholwet. Equivalent thresholds apply in every country we ship to. Attempting to circumvent the age-verification process is grounds for immediate account closure and may be reported to the relevant authority.
3. Formation of the contract
A binding sales contract is formed when we send you an order confirmation email referencing a specific order number. Until that point, your order constitutes an offer that we may decline (e.g., if the recipient address is not in a country we ship to, if a product is out of stock, or if we suspect the purchase is for resale).
4. Prices, taxes, and currency
All prices on the site are displayed in euro (EUR) and include Dutch VAT at the applicable rate (currently 21%) for orders shipping within the EU. For orders shipping outside the EU but to a country where we operate under a DDP arrangement (UK, Switzerland, Norway), the displayed price is inclusive of destination duties and VAT.
We reserve the right to correct pricing errors on the site at any time, including after an order has been placed but before despatch. If a price error has a material effect on your order, we will contact you with the option to confirm at the corrected price or cancel for a full refund.
5. Delivery
Estimated delivery times are documented on the shipping page and are indicative, not guaranteed. Risk passes to you at the moment the carrier hands the parcel to a person aged 18+ at the delivery address. If you arrange a redelivery to a different address, that becomes the contracted delivery point.
6. Right of withdrawal
Under EU Directive 2011/83/EU, consumers have a right of withdrawal of fourteen (14) days for most online purchases. Sealed alcoholic products are exempt from this right under Article 16(e) of the directive, because they cannot be returned for re-sale once the seal is broken or the bottle has been temperature-exposed.
Bottles damaged in transit, faulty products, and gift exchanges are handled under our returns policy, which sits alongside (not in place of) any statutory consumer protections you enjoy in your country of residence.
7. Payment
We accept major credit and debit cards, iDEAL, Bancontact, SEPA direct debit (for orders above €50), and Apple/Google Pay. Payment is captured at the moment the order is placed. We use Stripe and Mollie as our payment processors; we do not store your card details on our servers.
8. Responsible consumption
CYRUS is a member of Stichting Verantwoorde Alcoholconsumptie (STIVA) and complies with the Dutch Reclamecode voor Alcoholhoudende Dranken. Our products are intended for adult enjoyment as part of a balanced lifestyle. If you or someone close to you is struggling with alcohol, please contact alcoholinfo.nl (Netherlands) or drinkaware.co.uk (UK).
9. Liability
Our total liability for any claim arising under or in connection with the sale of products to you is limited to the purchase price of the products giving rise to the claim, except in cases of fraud, intent, gross negligence, death, or personal injury, for which liability is unlimited as required by applicable law.
10. Governing law and disputes
These terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in Amsterdam, except where mandatory consumer-protection rules in your country of residence give you a right to bring proceedings in a court closer to you. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11. Changes to these terms
We may amend these terms to reflect changes in the law, our business, or our products. The version applicable to your order is the one in force at the time we accept your order. We keep prior versions on file and can supply them on request.
